Abstract

The Maqāṣid al-Sharī‘ah approach is a crucial paradigm in the development of modern Ushul Fiqh. This approach emphasizes understanding the objectives of Islamic law (maqāṣid) as a foundation for legal reasoning, ensuring that Islamic rulings remain relevant to contemporary social dynamics. This study aims to analyze the role of the Maqāṣid al-Sharī‘ah approach as an analytical framework in modern Ushul Fiqh and its urgency in addressing evolving Islamic legal issues. The research employs a qualitative method with a library research design, examining classical and contemporary literature related to maqāṣid al-sharī‘ah and Ushul Fiqh. The findings indicate that the Maqāṣid al-Sharī‘ah approach significantly contributes to expanding ijtihad methods, particularly in resolving legal matters not explicitly addressed in primary Islamic sources. Morebover, this approach balances textual interpretation with contextual relevance, realizing the ultimate goal of Islamic blaw—public welfare. In conclusion, Maqāṣid al-Sharī‘ah serves not only as a complementary element in Ushul Fiqh bbut also as a strategic analytical framework for developing modern Islamic law that is adaptive and oriented toward the welfare of the community.
