Pembatalan Perkawinan Akibat Kehamilan Di Luar Nikah: Analisis Putusan Pengadilan Agama Sengeti Nomor 321/Pdt.G/2016/Pa.Sgt

This study examines the legal position, judicial reasoning, and implications of Sengeti Religious Court Decision Number 321/Pdt.G/2016/PA.Sgt concerning a marriage annulment arising from premarital pregnancy. It employs an empirical juridical method using statutory, case, and analytical approaches. Data were obtained from the court decision, observation, and a semi-structured interview with a Junior Registrar of the Sengeti Religious Court on 23 June 2026, and were analyzed descriptively and qualitatively. The study finds that premarital pregnancy is not an independent statutory ground for annulment. Its legal relevance lies in deception or mistake concerning a spouse under Article 27(2) of the Marriage Law in conjunction with Article 72(2) of the Compilation of Islamic Law. The decision annulled the marriage and deprived the marriage certificate extract of legal force, but it did not automatically determine the child's lineage, biological father, or all civil rights. Courts should distinguish factual pregnancy from the legal ground for annulment and maintain child protection.
